DECISION OF THE EEA JOINT COMMITTEE No 300/2024

amending Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement [2025/565]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 on the alignment of reporting obligations in the field of legislation related to the environment, and amending Regulations (EC) No 166/2006 and (EU) No 995/2010 of the European Parliament and of the Council, Directives 2002/49/EC, 2004/35/EC, 2007/2/EC, 2009/147/EC and 2010/63/EU of the European Parliament and of the Council, Council Regulations (EC) No 338/97 and (EC) No 2173/2005, and Council Directive 86/278/EEC ( 1 ) is to be incorporated into the EEA Agreement.

(2) Annexes II and XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex II to the EEA Agreement is amended as follows:

The following is added in point 7 (Directive 2010/63/EU of the European Parliament and of the Council) of Chapter XIII:

‘, as amended by:

— 32019 R 1010 : Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 ( OJ L 170, 25.6.2019, p. 115 ).

The provisions of this Directive shall, for the purposes of this Agreement, be read with the following adaptation:

In Article 43(4) and the third subparagraph of Article 54(2) the following sentence shall be added:

“The EFTA Surveillance Authority shall, as regards the EFTA States, have access to the database.” ’

The following is added in point 9c (Regulation (EU) No 995/2010 of the European Parliament and of the Council) of Chapter XVII:

‘, as amended by:

— 32019 R 1010 : Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 ( OJ L 170, 25.6.2019, p. 115 ).’

Article 2

Annex XX to the EEA Agreement shall be amended as follows:

The following is added in point 1h (Regulation (EC) No 166/2006 of the European Parliament and the Council):

‘, as amended by:

— 32019 R 1010 : Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 ( OJ L 170, 25.6.2019, p. 115 ).’

The following indent is added in points 1i (Directive 2004/35/EC of the European Parliament and of the Council) and 32 (Council Directive 86/278/EEC):

‘—

32019 R 1010 : Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 ( OJ L 170, 25.6.2019, p. 115 ).’

Point 1j (Directive 2007/2/EC of the European Parliament and of the Council) is amended as follows:

(i) the following is added:

‘, as amended by:

— 32019 R 1010 : Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 ( OJ L 170, 25.6.2019, p. 115 ).’;

(ii) in adaptation (b) the word “, 21(3)” is deleted.

The following is added in point 32g (Directive 2002/49/EC of the European Parliament and of the Council):

‘—

32019 R 1010 : Regulation (EU) 2019/1010 of the European Parliament and of the Council of 5 June 2019 ( OJ L 170, 25.6.2019, p. 115 ).

The provisions of this Directive shall, for the purposes of this Agreement, be read with the following adaptations:

(a) In Article 10(2), the following sentence shall be added:

“The EFTA Surveillance Authority shall, as regards the EFTA States, have access to the data repository.”

(b) In point 3 of Annex VI, the following sentence shall be added:

“The EFTA Surveillance Authority shall, as regards the EFTA States, have access to the digital information exchange mechanism.” ’

Article 3

The text of Regulation (EU) 2019/1010 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 7 December 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
