DECISION OF THE EEA JOINT COMMITTEE No 260/2024

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2025/618]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Directive (EU) 2020/177 of 11 February 2020 amending Council Directives 66/401/EEC, 66/402/EEC, 68/193/EEC, 2002/55/EC, 2002/56/EC and 2002/57/EC, Commission Directives 93/49/EEC and 93/61/EEC and Implementing Directives 2014/21/EU and 2014/98/EU as regards pests of plants on seeds and other plant reproductive material ( 1 ) is to be incorporated into the EEA Agreement.

(2) This Decision concerns legislation regarding phytosanitary matters. Legislation regarding phytosanitary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(3) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Part 1 of Chapter III of Annex I to the EEA Agreement shall be amended as follows:

The following indent is added in points 2 (Council Directive 66/401/EEC), 3 (Council Directive 66/402/EEC), 12 (Council Directive 2002/55/EC) and 13 (Council Directive 2002/57/EC):

‘—

32020 L 0177 : Commission Implementing Directive (EU) 2020/177 of 11 February 2020 ( OJ L 41, 13.2.2020, p. 1 ).’

Points 2 (Council Directive 66/401/EEC) and 3 (Council Directive 66/402/EEC) are amended as follows:

The existing adaptation is renumbered as (b).

The following shall be added before adaptation (b):

‘The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptations:

(a) References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement.’

Article 2

The text of Implementing Directive (EU) 2020/177 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 7 December 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
