DECISION OF THE EEA JOINT COMMITTEE No 59/2025

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2025/1038]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/2964 of 29 November 2024 approving reaction products of boric acid with didecylamine and ethylene oxide (polymeric betaine) as an existing active substance for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2024/2402 of 12 September 2024 not renewing the approval of sulfuryl fluoride for use in biocidal products of product-types 8 and 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2024/2930 of 28 November 2024 postponing the expiry date of the approval of dazomet for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Decision (EU) 2024/2945 of 29 November 2024 postponing the expiry date of the approval of tralopyril for use in biocidal products of product-type 21 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Decision (EU) 2024/2948 of 29 November 2024 on the non-approval of certain active substances for use in biocidal products in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 5 ) is to be incorporated into the EEA Agreement.

(6) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 12zzzzzzzzzzzk (Commission Implementing Decision (EU) 2024/2712) of Chapter XV of Annex II to the EEA Agreement:

32024 D 2948 : Commission Implementing Decision (EU) 2024/2948 of 29 November 2024 on the non-approval of certain active substances for use in biocidal products in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( OJ L, 2024/2948, 3.12.2024 ).’

Article 2

The texts of Implementing Regulation (EU) 2024/2964 and Implementing Decisions (EU) 2024/2402, (EU) 2024/2930, (EU) 2024/2945 and (EU) 2024/2948 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 15 March 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
