DECISION No 1/2020 OF THE JOINT COMMITTEE ON AGRICULTURE

of 31 July 2020

on amending Annex 12 to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products [2020/1386]

THE JOINT COMMITTEE ON AGRICULTURE,
Having regard to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products  ( 1 ) , and in particular Article 11 thereof,
Whereas:
(1) The Agreement between the European Community and the Swiss Confederation on trade in agricultural products (‘the Agreement’) entered into force on 1 June 2002.
(2) Annex 12 to the Agreement concerns the protection of designations of origin and geographical indications (GIs) for agricultural products and foodstuffs.
(3) In accordance with Article 16(1) of Annex 12 to the Agreement, Switzerland and the European Union have examined the GIs registered in the European Union and Switzerland respectively in 2015 and 2016 and carried out the public consultation provided for in Article 3 of the said Annex, with a view to their protection.
(4) Pursuant to Article 15(6) of Annex 12 to the Agreement, the Working Group on PDOs and PGIs set up in accordance with Article 6(7) of the Agreement assists the Committee at the latter’s request. The Working Group has recommended to the Committee that the list of GIs in Appendix 1 and the list of the Parties’ legislation in Appendix 2 to Annex 12 to the Agreement be amended,
HAS DECIDED AS FOLLOWS:

Article 1

Appendices 1 and 2 to Annex 12 to the Agreement between the European Community and the Swiss Confederation on trade in agricultural products shall be replaced by the text contained in the Annex to this Decision.

Article 2

The protection of the Swiss GI ‘Zuger Kirschtorte’ listed in Appendix 1 to Annex 12 to the Agreement, as amended by this Decision, shall not prevent, for a transitional period of two years from the entry into force of this Decision, the continued use in the Union of that name to denote and present certain comparable products not originating in Switzerland.

Article 3

This Decision shall enter into force on 1 November 2020.
