DECISION OF THE EEA JOINT COMMITTEE No 189/2024

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/3068]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/1054 of 10 April 2024 concerning the authorisation of a preparation of Weizmannia faecalis DSM 32016 as a feed additive for use in feed and in water for drinking for all poultry species reared for laying or breeding and for use in water for drinking for all poultry species for fattening, ornamental birds, suckling and weaned Suidae piglets (holder of the authorisation: Biochem Zusatzstoffe Handels- und Produktionsges. mbH), and amending Implementing Regulation (EU) 2020/1755 as regards the terms of the authorisation of that preparation ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2024/1055 of 10 April 2024 concerning the authorisation of iron(II) – betaine complex as a feed additive for all animal species ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2024/1056 of 10 April 2024 concerning the authorisation of riboflavin 5’-phosphate monosodium salt (vitamin B 2 ), produced by Bacillus subtilis KCCM 10445, as a feed additive for all animal species ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2024/1057 of 10 April 2024 concerning the authorisation of a preparation of 6-phytase produced by Komagataella phaffii CGMCC 7.19 as a feed additive for all poultry species for fattening or reared for laying and ornamental birds (holder of authorisation: Nutrex N.V.) ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2024/1058 of 10 April 2024 concerning the renewal of the authorisation of a preparation of endo–1,4-beta-xylanase produced by Aspergillus oryzae DSM 33700 as a feed additive for poultry for fattening, weaned piglets, pigs for fattening, lactating sows and laying hens, the change of the terms of the authorisation and authorisation of new uses of that preparation as a feed additive for all poultry species and all Suidae (holder of authorisation: DSM Nutritional Products Ltd, represented by DSM Nutritional Products Sp. z o.o.) and repealing Implementing Regulations (EU) No 1206/2012, (EU) No 2020/995 and (EU) 2020/1034 ( 5 ) is to be incorporated into the EEA Agreement.

(6) Implementing Regulation (EU) 2024/1058 repeals Implementing Regulation (EU) No 1206/2012 ( 6 ) , Implementing Regulation (EU) 2020/995 ( 7 ) and Implementing Regulation (EU) 2020/1034 ( 8 ) which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(7) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(8) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The following is added in point 376 (Commission Implementing Regulation (EU) 2020/1755):

— 32024 R 1054 : Commission Implementing Regulation (EU) 2024/1054 of 10 April 2024 ( OJ L, 2024/1054, 11.4.2024 ).’

The following points are inserted after point 571 (Commission Implementing Regulation (EU) 2024/997):

The texts of points 74 (Commission Implementing Regulation (EU) No 1206/2012), 325 (Commission Implementing Regulation (EU) 2020/995) and 331 (Commission Implementing Regulation (EU) 2020/1034) as well as the second indent (Commission Implementing Regulation (EU) No 1206/2012) in point 1zzs (Commission Regulation (EC) No 2036/2005), are deleted.

Article 2

The texts of Implementing Regulations (EU) 2024/1054, (EU) 2024/1055, (EU) 2024/1056, (EU) 2024/1057 and (EU) 2024/1058 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 24 September 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
