DECISION OF THE EEA JOINT COMMITTEE No 204/2024

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/3058]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Decision (EU) 2024/734 of 27 February 2024 postponing the expiry date of the approval of brodifacoum, bromadiolone, chlorophacinone, coumatetralyl, difenacoum, difethialone and flocoumafen for use in biocidal products of product-type 14 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2024/731 of 28 February 2024 postponing the expiry date of the approval of indoxacarb for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2024/732 of 28 February 2024 postponing the expiry date of the approval of aluminium phosphide for use in biocidal products of product-types 14 and 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Decision (EU) 2024/733 of 28 February 2024 postponing the expiry date of the approval of cholecalciferol for use in biocidal products of product-type 14 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Decision (EU) 2024/787 of 28 February 2024 postponing the expiry date of the approval of magnesium phosphide for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 5 ) is to be incorporated into the EEA Agreement.

(6) Commission Implementing Decision (EU) 2024/816 of 5 March 2024 addressing questions regarding the second comparative assessment of anticoagulant rodenticide biocidal products in accordance with Article 23(5) of Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 6 ) is to be incorporated into the EEA Agreement.

(7) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

The following point is inserted after point 12nnz (Commission Implementing Decision (EU) 2016/1175):

32024 D 0816 : Commission Implementing Decision (EU) 2024/816 of 5 March 2024 addressing questions regarding the second comparative assessment of anticoagulant rodenticide biocidal products in accordance with Article 23(5) of Regulation (EU) No 528/2012 of the European Parliament and of the Council ( OJ L, 2024/816, 7.3.2024 ).’

The following points are inserted after point 12zzzzzzzzzzm (Commission Implementing Regulation (EU) 2024/893):

Article 2

The texts of Implementing Decisions (EU) 2024/734, (EU) 2024/731, (EU) 2024/732, (EU) 2024/733, (EU) 2024/787 and (EU) 2024/816 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 24 September 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
