DECISION OF THE EEA JOINT COMMITTEE No 187/2024

of 23 September 2024

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/3073]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/749 of 29 February 2024 concerning the authorisation of lignosulphonate as a feed additive for all animal species  ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2024/762 of 1 March 2024 correcting Implementing Regulation (EU) 2022/415 concerning the authorisation of malic acid, citric acid produced by Aspergillus niger DSM 25794 or CGMCC 4513/CGMCC 5751 or CICC 40347/CGMCC 5343, sorbic acid and potassium sorbate, acetic acid, sodium diacetate and calcium acetate, propionic acid, sodium propionate, calcium propionate and ammonium propionate, formic acid, sodium formate, calcium formate and ammonium formate, and lactic acid produced by Bacillus coagulans (LMG S-26145 or DSM 23965), or Bacillus smithii (LMG S-27890) or Bacillus subtilis (LMG S-27889) and calcium lactate as feed additives for all animal species  ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2024/777 of 5 March 2024 concerning the authorisation of L-lysine base, liquid, L-lysine monohydrochloride, liquid, and L-lysine monohydrochloride produced by Escherichia coli NITE BP-02917 as feed additives for all animal species  ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2024/778 of 5 March 2024 concerning the authorisation of a preparation of protease produced by Bacillus licheniformis DSM 33099 as a feed additive for all poultry species for fattening, reared for laying and reared for breeding (holder of authorisation: DSM Nutritional Products Ltd)  ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2024/780 of 5 March 2024 concerning the renewal of the authorisation of a preparation of endo–1,4-beta-xylanase produced by Trichoderma citrinoviride DSM 34663 as a feed additive for all poultry species for fattening, all poultry species for laying and reared for laying, weaned piglets, pigs for fattening and carp, the authorisation of that preparation as a feed additive for all poultry species for breeding, turkeys reared for breeding, minor poultry species reared for breeding, ornamental birds, suckling piglets and minor porcine species for fattening (holder of authorisation: Huvepharma NV) and repealing Implementing Regulations (EU) 2015/1043, (EU) 2017/1906 and (EU) 2018/327  ( 5 ) is to be incorporated into the EEA Agreement.

(6) Commission Implementing Regulation (EU) 2024/781 of 5 March 2024 concerning the renewal of the authorisation of a preparation of alpha-galactosidase produced by Saccharomyces cerevisiae CBS 615.94 and endo-1,4-beta-glucanase produced by Aspergillus niger CBS 120604 as a feed additive for chickens for fattening, minor poultry species for fattening and chickens reared for laying (holder of authorisation: Kerry Ingredients & Flavours Ltd.) and repealing Implementing Regulations (EU) No 237/2012 and (EU) No 1365/2013  ( 6 ) is to be incorporated into the EEA Agreement.

(7) Commission Implementing Regulation (EU) 2024/794 of 5 March 2024 concerning the authorisation of a preparation of endo-1,4-beta-xylanase produced by Komagataella phaffii CGMCC 7.371 as a feed additive for all avian species and piglets of all Suidae species (holder of authorisation: Victory Enzymes GmbH)  ( 7 ) is to be incorporated into the EEA Agreement.

(8) Commission Implementing Regulation (EU) 2024/786 of 6 March 2024 concerning the authorisation of a preparation of thyme oil, star anise oil and quillaja bark powder as a feed additive for all poultry species for fattening (holder of authorisation: Delacon Biotechnik GmbH)  ( 8 ) is to be incorporated into the EEA Agreement.

(9) Commission Implementing Regulation (EU) 2024/806 of 7 March 2024 concerning the authorisation of pine tincture from Pinus sylvestris L. as a feed additive for all animal species  ( 9 ) is to be incorporated into the EEA Agreement.

(10) Commission Implementing Regulation (EU) 2024/824 of 8 March 2024 concerning the authorisation of gentian tincture from Gentiana lutea L. as a feed additive for certain animal species  ( 10 ) is to be incorporated into the EEA Agreement.

(11) Implementing Regulation (EU) 2024/780 repeals Commission Implementing Regulations (EU) 2015/1043  ( 11 ) , (EU) 2017/1906  ( 12 ) and (EU) 2018/327  ( 13 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(12) Implementing Regulation (EU) 2024/781 repeals Commission Implementing Regulations (EU) No 237/2012  ( 14 ) and (EU) No 1365/2013  ( 15 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(13) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(14) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The texts of points 2zzf (Commission Implementing Regulation (EU) No 237/2012), 2zzy (Commission Implementing Regulation (EU) No 1365/2013), 138 (Commission Implementing Regulation (EU) 2015/1043), 228 (Commission Implementing Regulation (EU) 2017/1906), 257 (Commission Implementing Regulation (EU) 2018/327) as well as the second indent (Commission Implementing Regulation (EU) 2015/1043) to point 1zzzzx (Commission Regulation (EC) No 322/2009), are deleted.

Article 2

The texts of Implementing Regulations (EU) 2024/749, (EU) 2024/762, (EU) 2024/777, (EU) 2024/778, (EU) 2024/780, (EU) 2024/781, (EU) 2024/794, (EU) 2024/786, (EU) 2024/806 and (EU) 2024/824 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 24 September 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
