DECISION OF THE EEA JOINT COMMITTEE No 191/2024

of 23 September 2024

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/3072]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/1199 of 18 April 2024 concerning the authorisation of manganese(II) – betaine complex as a feed additive for all animal species ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2024/1200 of 18 April 2024 concerning the renewal of the authorisation of a preparation of Bifidobacterium animalis ssp. animalis DSM 16284, Ligilactobacillus salivarius DSM 16351 and Enterococcus faecium DSM 21913 as a feed additive for chickens for fattening, chickens reared for laying and minor poultry species for fattening and reared for laying or breeding, the authorisation of that preparation as a feed additive for use in feed and in water for drinking for chickens reared for breeding, turkeys for fattening and turkeys reared for breeding (holder of authorisation: Biomin GmbH) and repealing Implementing Regulations (EU) No 544/2013 and (EU) 2015/1105 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2024/1161 of 22 April 2024 concerning the renewal of the authorisation of a preparation of Enterococcus lactis NCIMB 10415 as a feed additive for certain animal species, the authorisation of that preparation as a feed additive for certain other animal species (holder of authorisation: DSM Nutritional Products Ltd.), amending Implementing Regulation (EU) No 1061/2013 and repealing Implementing Regulations (EU) No 361/2011, (EU) 2015/518 and (EU) 2019/11 ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2024/1179 of 23 April 2024 concerning the renewal of the authorisation of preparations of Lactiplantibacillus plantarum DSM 3676, Lactiplantibacillus plantarum DSM 3677 and Lentilactobacillus buchneri DSM 13573 as feed additives for all animal species and repealing Implementing Regulation (EU) No 1119/2012 ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2024/1185 of 24 April 2024 concerning the renewal of the authorisation of orthophosphoric acid as a feed additive for all animal species and repealing Implementing Regulation (EU) No 1055/2013 ( 5 ) is to be incorporated into the EEA Agreement.

(6) Commission Implementing Regulation (EU) 2024/1186 of 24 April 2024 concerning the authorisation of cinnamon bark essential oil and cinnamon leaf essential oil from Cinnamomum verum J. Presl as feed additives for certain animal species ( 6 ) is to be incorporated into the EEA Agreement.

(7) Commission Implementing Regulation (EU) 2024/1187 of 24 April 2024 concerning the renewal of the authorisation of a preparation of Enterococcus lactis DSM 7134 and Lacticaseibacillus rhamnosus DSM 7133 as a feed additive for calves for rearing (holder of authorisation: Lactosan GmbH & Co.KG) and repealing Implementing Regulation (EU) No 1101/2013 ( 7 ) is to be incorporated into the EEA Agreement.

(8) Commission Implementing Regulation (EU) 2024/1189 of 24 April 2024 concerning the renewal of the authorisation of a preparation of Lactiplantibacillus plantarum LMG P-21295 as a feed additive for all animal species and amending Implementing Regulation (EU) No 1065/2012 ( 8 ) is to be incorporated into the EEA Agreement.

(9) Commission Implementing Regulation (EU) 2024/1190 of 24 April 2024 concerning the renewal of the authorisation of a preparation of Enterococcus lactis DSM 7134 as a feed additive for chickens reared for laying and minor poultry species for fattening, reared for laying and reared for breeding (holder of authorisation: Lactosan GmbH & Co.KG) and repealing Implementing Regulation (EU) No 775/2013 ( 9 ) is to be incorporated into the EEA Agreement.

(10) Commission Implementing Regulation (EU) 2024/1193 of 24 April 2024 concerning the renewal of the authorisation of sodium hydroxide as a feed additive for cats, dogs and ornamental fish and repealing Implementing Regulation (EU) No 161/2013 ( 10 ) is to be incorporated into the EEA Agreement.

(11) Commission Implementing Regulation (EU) 2024/1194 of 24 April 2024 concerning the renewal of the authorisation of nicotinic acid and niacinamide as feed additives for all animal species and repealing Implementing Regulation (EU) No 642/2013 ( 11 ) is to be incorporated into the EEA Agreement.

(12) Commission Implementing Regulation (EU) 2024/1195 of 24 April 2024 concerning the authorisation of cassia essential oil from Cinnamomum aromaticum Nees as a feed additive for certain animal species ( 12 ) is to be incorporated into the EEA Agreement.

(13) Commission Implementing Regulation (EU) 2024/1196 of 25 April 2024 concerning the renewal of the authorisation of a preparation of Lentilactobacillus buchneri DSM 19455 as a feed additive for all animal species and repealing Implementing Regulation (EU) No 774/2013 ( 13 ) is to be incorporated into the EEA Agreement.

(14) Implementing Regulation (EU) 2024/1200 repeals Implementing Regulations (EU) No 544/2013 ( 14 ) and (EU) 2015/1105 ( 15 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(15) Implementing Regulation (EU) 2024/1161 repeals Implementing Regulations (EU) No 361/2011 ( 16 ) , (EU) 2015/518 ( 17 ) and (EU) 2019/11 ( 18 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(16) Implementing Regulation (EU) 2024/1179 repeals Implementing Regulation (EU) No 1119/2012 ( 19 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(17) Implementing Regulation (EU) 2024/1185 repeals Implementing Regulation (EU) No 1055/2013 ( 20 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(18) Implementing Regulation (EU) 2024/1187 repeals Implementing Regulation (EU) No 1101/2013 ( 21 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(19) Implementing Regulation (EU) 2024/1190 repeals Implementing Regulation (EU) No 775/2013 ( 22 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(20) Implementing Regulation (EU) 2024/1193 repeals Implementing Regulation (EU) No 161/2013 ( 23 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(21) Implementing Regulation (EU) 2024/1194 repeals Implementing Regulation (EU) No 642/2013 ( 24 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(22) Implementing Regulation (EU) 2024/1196 repeals Implementing Regulation (EU) No 774/2013 ( 25 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(23) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(24) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The following is added in point 2zzr (Commission Implementing Regulation (EU) No 1061/2013):

Article 2

The texts of Implementing Regulations (EU) 2024/1199, (EU) 2024/1200, (EU) 2024/1161, (EU) 2024/1179, (EU) 2024/1185, (EU) 2024/1186, (EU) 2024/1187, (EU) 2024/1189, (EU) 2024/1190, (EU) 2024/1193, (EU) 2024/1194, (EU) 2024/1195 and (EU) 2024/1196 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 24 September 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
