DECISION OF THE EEA JOINT COMMITTEE No 153/2024

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/2532]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/750 of 29 February 2024 concerning the renewal of the authorisation of thaumatin as a feed additive for all animal species and repealing Implementing Regulation (EU) No 869/2012 ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2024/752 of 29 February 2024 concerning the denial of authorisation of a preparation of astaxanthin-rich Phaffia rhodozyma (ATCC SD-5340) as a feed additive for salmon and trout ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2024/754 of 29 February 2024 amending Implementing Regulation (EU) 2020/1762 as regards the terms of the authorisation of a preparation of Bacillus subtilis DSM 32324, Bacillus subtilis DSM 32325 and Bacillus amyloliquefaciens DSM 25840 as a feed additive for all poultry species for fattening or reared for laying or reared for breeding (holder of authorisation: Chr. Hansen A/S) ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2024/763 of 29 February 2024 concerning the renewal of the authorisation of preparations of Lactiplantibacillus plantarum NCIMB 30083 and Lactiplantibacillus plantarum NCIMB 30084 as feed additives for all animal species and repealing Implementing Regulation (EU) No 308/2013 ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2024/764 of 29 February 2024 concerning the authorisation of a preparation of Bacillus subtilis CNCM I-4606, CNCM I-5043 and CNCM I-4607 and Lactococcus lactis CNCM I-4609 as a feed additive for all animal species ( 5 ) is to be incorporated into the EEA Agreement.

(6) Implementing Regulation (EU) 2024/750 repeals Commission Implementing Regulation (EU) No 869/2012 ( 6 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(7) Implementing Regulation (EU) 2024/763 repeals Commission Implementing Regulation (EU) No 308/2013 ( 7 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(8) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(9) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

32024 R 0764 : Commission Implementing Regulation (EU) 2024/764 of 29 February 2024 concerning the authorisation of a preparation of Bacillus subtilis CNCM I-4606, CNCM I-5043 and CNCM I-4607 and Lactococcus lactis CNCM I-4609 as a feed additive for all animal species ( OJ L, 2024/764, 1.3.2024 ).’

The texts of points 67 (Commission Implementing Regulation (EU) No 869/2012) and 81 (Commission Implementing Regulation (EU) No 308/2013) are deleted.

Article 2

The texts of Implementing Regulations (EU) 2024/750, (EU) 2024/752, (EU) 2024/754, (EU) 2024/763 and (EU) 2024/764 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 6 July 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
