DECISION OF THE EEA JOINT COMMITTEE No 169/2024

amending Annex XI (Electronic communication, audiovisual services and information society) to the EEA Agreement [2024/2568]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Decision EU 2023/1795 of 10 July 2023 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate level of protection of personal data under the EU-US Data Privacy Framework ( 1 ) is to be incorporated into the EEA Agreement.

(2) Regulation (EU) 2016/679 of the European Parliament and of the Council ( 2 ) was incorporated into the EEA Agreement by Decision of the EEA Joint Committee No 154/2018 ( 3 ) . Pursuant to adaptation (e) to Regulation (EU) 2016/679 in point 5e of Annex XI to the EEA Agreement, Iceland, Liechtenstein and Norway have applied the measures contained in Implementing Decision (EU) 2022/254 at the same time as the EU Member States.

(3) Annex XI to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following point is inserted after point 5ew (Commission Implementing Decision (EU) 2021/915) of Annex XI to the EEA Agreement:

‘5ex.

32023 D 1795 : Commission Implementing Decision EU 2023/1795 of 10 July 2023 pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the adequate level of protection of personal data under the EU-US Data Privacy Framework ( OJ L 231, 20.9.2023, p. 118 ).’

Article 2

The text of Implementing Decision EU 2023/1795 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 6 July 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
