DECISION OF THE EEA JOINT COMMITTEE No 288/2023

amending Annex XIII (Transport) to the EEA Agreement [2024/1114]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Directive (EU) 2022/993 of the European Parliament and of the Council of 8 June 2022 on the minimum level of training of seafarers ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2022/1973 of 11 October 2022 on the recognition of the United Kingdom pursuant to Directive (EU) 2022/993 as regards the system for training and certification of seafarers ( 2 ) is to be incorporated into the EEA Agreement.

(3) Directive (EU) 2022/993 repeals Directive 2008/106/EC of the European Parliament and of the Council ( 3 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(4) Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

The text of point 56j (Directive 2008/106/EC of the European Parliament and of the Council) is replaced by the following:

‘ 32022 L 0993 : Directive (EU) 2022/993 of the European Parliament and of the Council of 8 June 2022 on the minimum level of training of seafarers ( OJ L 169, 27.6.2022, p. 45 ).

The provisions of this Directive shall, for the purpose of this Agreement, be read with the following adaptation:

This Directive shall not apply to Liechtenstein.’

The following point is inserted after point 56jx (Commission Implementing Decision (EU) 2018/501):

‘56jy.

32022 D 1973 : Commission Implementing Decision (EU) 2022/1973 of 11 October 2022 on the recognition of the United Kingdom pursuant to Directive (EU) 2022/993 as regards the system for training and certification of seafarers ( OJ L 270, 18.10.2022, p. 99 ).’

Article 2

The texts of Directive (EU) 2022/993 and Implementing Decision (EU) 2022/1973 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 28 October 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
