DECISION OF THE EEA JOINT COMMITTEE No 267/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1136]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2023/1608 of 30 May 2023 amending Annex I to Regulation (EU) 2019/1021 of the European Parliament and of the Council as regards the listing of perfluorohexane sulfonic acid (PFHxS), its salts and PFHxS-related compounds ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2023/1423 of 5 July 2023 repealing Implementing Decision (EU) 2022/1486 postponing the expiry date of the approval of acrolein for use in biocidal products of product-type 12 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2023/1424 of 5 July 2023 not renewing the approval of acrolein for use in biocidal products of product-type 12 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2023/1421 of 6 July 2023 approving sulfur dioxide released from sodium metabisulfite as an active substance for use in biocidal products of product-type 9 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2023/1429 of 7 July 2023 approving Chrysanthemum cinerariaefolium extract from open and mature flowers of Tanacetum cinerariifolium obtained with supercritical carbon dioxide as an active substance for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 5 ) is to be incorporated into the EEA Agreement.

(6) Implementing Decision (EU) 2023/1423 repeals Commission Implementing Decision (EU) 2022/1486 ( 6 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(7) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex II to the EEA Agreement shall be amended as follows:

The following indent is added in point 12w (Regulation (EU) 2019/1021 of the European Parliament and of the Council):

32023 R 1429 : Commission Implementing Regulation (EU) 2023/1429 of 7 July 2023 approving Chrysanthemum cinerariaefolium extract from open and mature flowers of Tanacetum cinerariifolium obtained with supercritical carbon dioxide as an active substance for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( OJ L 175, 10.7.2023, p. 12 ).’

The text of point 12zzzzzzzzf (Commission Implementing Decision (EU) 2022/1486) is deleted.

Article 2

The texts of Delegated Regulation (EU) 2023/1608, Implementing Regulations (EU) 2023/1421 and (EU) 2023/1429, and Implementing Decisions (EU) 2023/1423 and (EU) 2023/1424 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 28 October 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
