DECISION OF THE EEA JOINT COMMITTEE No 284/2023

amending Annex IX (Financial services) to the EEA Agreement [2024/1116]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2023/944 of 17 January 2023 amending and correcting the regulatory technical standards laid down in Delegated Regulation (EU) 2017/587 as regards certain transparency requirements applicable to transactions in equity instruments ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Delegated Regulation (EU) 2023/945 of 17 January 2023 amending the regulatory technical standards laid down in Delegated Regulation (EU) 2017/583 as regards certain transparency requirements applicable to transactions in non-equity instruments ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Delegated Regulation (EU) 2023/960 of 1 February 2023 amending the regulatory technical standards laid down in Delegated Regulation (EU) 2017/588 as regards the annual application date of the calculations of the average daily number of transactions for shares, depository receipts and exchange-traded funds for the purposes of the tick sizes ( 3 ) is to be incorporated into the EEA Agreement.

(4) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

The following indent is added in point 31bazd (Commission Delegated Regulation (EU) 2017/587):

‘—

32023 R 0944 : Commission Delegated Regulation (EU) 2023/944 of 17 January 2023 ( OJ L 131, 16.5.2023, p. 1 ).’

The following indent is added in point 31baz (Commission Delegated Regulation (EU) 2017/583):

‘—

32023 R 0945 : Commission Delegated Regulation (EU) 2023/945 of 17 January 2023 ( OJ L 131, 16.5.2023, p. 17 ).’

The following indent is added in point 31baze (Commission Delegated Regulation (EU) 2017/588):

‘—

32023 R 0960 : Commission Delegated Regulation (EU) 2023/960 of 1 February 2023 ( OJ L 129, 16.5.2023, p. 1 ).’

Article 2

The texts of Delegated Regulations (EU) 2023/944, (EU) 2023/945 and (EU) 2023/960 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 28 October 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
