DECISION OF THE EEA JOINT COMMITTEE No 315/2023

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1404]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Regulation (EU) 2023/464 of 3 March 2023 amending, for the purpose of its adaptation to technical progress, the Annex to Regulation (EC) No 440/2008 laying down test methods pursuant to Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2023/470 of 2 March 2023 not approving d-Allethrin as an existing active substance for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2023/471 of 2 March 2023 postponing the expiry date of the approval of 4,5-Dichloro-2-octyl-2H-isothiazol-3-one for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

The following indent is added in point 12zza (Council Regulation (EC) No 440/2008):

Article 2

The texts of Regulation (EU) 2023/464 and Implementing Decisions (EU) 2023/470 and (EU) 2023/471 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 9 December 2023, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( 4 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
