DECISION OF THE EEA JOINT COMMITTEE No 62/2024

of 15 March 2024

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1597]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2023/2088 of 28 September 2023 approving reaction mass of N,N-didecyl-N-(2-hydroxyethyl)-N-methylammonium propionate and N,N-didecyl-N-(2-(2-hydroxyethoxy)ethyl)-N-methylammonium propionate and N,N-didecyl-N-(2-(2-(2-hydroxyethoxy)ethoxy)ethyl)-N-methylammonium propionate as an active substance for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2023/2596 of 21 November 2023 renewing the approval of propiconazole as an active substance for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2023/2620 of 24 November 2023 approving sulfur dioxide generated from sulfur by combustion as an active substance for use in biocidal products of product-type 4 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2023/2643 of 27 November 2023 approving formic acid as an existing active substance for use in biocidal products of product-types 2, 3, 4 and 5 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Decision (EU) 2023/2622 of 24 November 2023 not approving silver zinc zeolite as an existing active substance for use in biocidal products of product-type 4 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 5 ) is to be incorporated into the EEA Agreement.

(6) Commission Implementing Decision (EU) 2023/2630 of 27 November 2023 on the unresolved objections regarding the conditions for granting an authorisation for the product Procalx in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 6 ) is to be incorporated into the EEA Agreement.

(7) Commission Implementing Decision (EU) 2023/2648 of 27 November 2023 not approving silver zeolite as an existing active substance for use in biocidal products of product-type 4 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 7 ) is to be incorporated into the EEA Agreement.

(8) Commission Implementing Decision (EU) 2023/2672 of 27 November 2023 on the unresolved objections regarding the terms and conditions of the authorisation of the biocidal product family INTEROX Biocidal Product Family 2 raised in accordance with Article 36 of Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 8 ) is to be incorporated into the EEA Agreement.

(9) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 12zzzzzzzzzu (Commission Implementing Decision (EU) 2023/2386) of Chapter XV of Annex II to the EEA Agreement:

32023 D 2672 : Commission Implementing Decision (EU) 2023/2672 of 27 November 2023 on the unresolved objections regarding the terms and conditions of the authorisation of the biocidal product family INTEROX Biocidal Product Family 2 raised in accordance with Article 36 of Regulation (EU) No 528/2012 of the European Parliament and of the Council ( OJ L, 2023/2672, 29.11.2023 ).’

Article 2

The texts of Implementing Regulations (EU) 2023/2088, (EU) 2023/2596, (EU) 2023/2620 and (EU) 2023/2643 and Implementing Decisions (EU) 2023/2622, (EU) 2023/2630, (EU) 2023/2648 and (EU) 2023/2672 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 16 March 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
