DECISION OF THE EEA JOINT COMMITTEE No 85/2024

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/1906]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2023/2732 of 7 December 2023 concerning the authorisation of a preparation of Macleaya cordata mixture as a feed additive for all poultry species for fattening (holder of authorisation: Phytobiotics Futterzusatzstoffe GmbH) ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2023/2733 of 7 December 2023 concerning the authorisation of a preparation of diclazuril (Coxiril) as a feed additive for chickens reared for laying and pheasants (holder of authorisation: Huvepharma NV) and correcting Implementing Regulation (EU) 2015/46 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2023/2734 of 7 December 2023 concerning the authorisation of a preparation of Saccharomyces cerevisiae DBVPG 48 SF as a feed additive for horses, dairy ruminants and pigs (holder of authorisation: Mazzoleni S.p.A.) ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2023/2736 of 7 December 2023 concerning the authorisation of a preparation of Bacillus velezensis NITE BP-01844 as a feed additive for all poultry species for fattening, chickens reared for laying, turkeys reared for breeding, minor poultry species reared for laying or for breeding and ornamental birds (holder of authorisation: Toa Biopharma Co., Ltd) ( 4 ) is to be incorporated into the EEA Agreement.

(5) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(6) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The following is added in point 124 (Commission Implementing Regulation (EU) 2015/46):

‘, as amended by:

The following points are inserted after point 536 (Commission Implementing Regulation (EU) 2023/1334):

Article 2

The texts of Implementing Regulations (EU) 2023/2732, (EU) 2023/2733, (EU) 2023/2734 and (EU) 2023/2736 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 27 April 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
