DECISION OF THE EEA JOINT COMMITTEE

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) No 414/2013 of 6 May 2013 specifying a procedure for the authorisation of same biocidal products in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2) Commission Delegated Regulation (EU) No 736/2013 of 17 May 2013 amending Regulation (EU) No 528/2012 of the European Parliament and of the Council as regards the duration of the work programme for examination of existing biocidal active substances (2) is to be incorporated into the EEA Agreement.

(3) Commission Regulation (EU) No 613/2013 of 25 June 2013 amending Regulation (EC) No 1451/2007 as regards additional active substances of biocidal products to be examined under the review programme (3) is to be incorporated into the EEA Agreement.

(4) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

(1) the following is added in point 12n (Regulation (EU) No 528/2012 of the European Parliament and of the Council):

(2) the following indent is added in point 12ze (Commission Regulation (EC) No 1451/2007):

(3) the following point is inserted after point 12zzo (Commission Decision 2013/204/EU):

Article 2

The texts of Implementing Regulation (EU) No 414/2013, Regulation (EU) No 613/2013 and Delegated Regulation (EU) No 736/2013 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the

Official Journal of the European Union

, shall be authentic.

Article 3

This Decision shall enter into force on 15 February 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made

, or on the day of the entry into force of Decision of the EEA Joint Committee No 225/2013 of 13 December 2013 (4), into the EEA Agreement, whichever is the later.

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the

Official Journal of the European Union
