on the specification of reference CO

2 emissions of heavy-duty vehicle groups not covered by Regulation (EU) 2019/1242 of the European Parliament and of the Council pursuant to Directive 1999/62/EC of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 1999/62/EC of the European Parliament and of the Council of 17 June 1999 on the charging of vehicles for the use of road infrastructures (1), and in particular Article 7ga(7) thereof,

Whereas:

(1) In accordance with Article 7ga(1) of Directive 1999/62/EC, Member States are to vary infrastructure charges and user charges for heavy-duty vehicles. The variation is to be based on reference CO

emissions within the meaning of Article 2(1), point (38)(b), of Directive 1999/62/EC, and is calculated differently for various vehicles groups referred to in Article 4 of Commission Regulation (EU) 2017/2400 (2). For a vehicle group that is not covered by Regulation (EU) 2019/1242 of the European Parliament and of the Council (3), the reference CO

emissions is to be based on the data reported under Regulation (EU) 2018/956 of the European Parliament and of the Council (4) and is to correspond to the average value of all CO

emissions of vehicles in that vehicle group.

(2) In accordance with Article 10 of Regulation (EU) 2018/956, the Commission published a report (5) analysing the data on heavy-duty vehicles for the reporting period 2020 running from 1 July 2020 to 30 June 2021. The report includes the data for a number of vehicle groups for their first complete reporting period.

(3) This Implementing Decision should specify the reference CO

emissions for vehicle groups 1, 2, 3, 11, 12 and 16, by reproducing the data relevant for each of those vehicle groups as published in the report referred to in recital 2,

HAS ADOPTED THIS DECISION:

Article 1

The reference CO

emissions for vehicle groups not covered by Regulation (EU) 2019/1242, as defined in Article 2(1), point (38)(b), of Directive 1999/62/EC, are set out in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the

Official Journal of the European Union
