COUNCIL DECISION (EU) 2023/2756

of 4 December 2023

authorising the opening of negotiations with the State of Israel for an agreement on civil aviation safety

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 100(2), in conjunction with Article 218(3) and (4) thereof,
Having regard to the recommendation from the European Commission,
Whereas:
(1) Negotiations should be opened with a view to concluding an agreement on civil aviation safety with the State of Israel.
(2) The Commission should be nominated as the Union negotiator.
(3) The negotiations should be conducted by the Commission in consultation with the special committee provided for in Article 218(4) of the Treaty on the Functioning of the European Union (TFEU), and in accordance with the respective roles of the institutions set out in Article 13(2) of the Treaty on European Union and in Article 218 TFEU, as interpreted by the Court of Justice of the European Union.
(4) The main objective of the envisaged agreement is to establish a legal framework which covers the certification of aeronautical products, parts and appliances, and production oversight. Until recently, the approval of certificates for aeronautical products and their parts and appliances between the Union and the State of Israel was based on an agreement between Italy and the State of Israel, which entered into force on 2 May 1990, in conjunction with Article 68(1), point (c), of Regulation (EU) 2018/1139 of the European Parliament and of the Council (1). However, Italy terminated that agreement with effect from 2 January 2022 in accordance with Article 140(6) of that Regulation,
HAS ADOPTED THIS DECISION:

Article 1

1.   The Commission is hereby authorised to open negotiations for an agreement on civil aviation safety with the State of Israel.
2.   The negotiations shall be conducted on the basis of the negotiating directives of the Council set out in the addendum to this Decision.

Article 2

The Commission is hereby nominated as the Union negotiator.

Article 3

1.   The negotiations shall be conducted in consultation with the Working Party on Aviation, which is hereby designated as the special committee provided for in Article 218(4) TFEU.
2.   The Commission shall report promptly in writing to the special committee and to the Council on the outcome of the negotiations after each negotiating session.

This Decision is addressed to the Commission.
