DECISION OF THE EEA JOINT COMMITTEE No 136/2020

amending Annex XI (Electronic communication, audiovisual services and information society) and Protocol 37 (Containing the list provided for in Article 101) to the EEA Agreement [2023/1395]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Directive 2008/6/EC of the European Parliament and of the Council of 20 February 2008 amending Directive 97/67/EC with regard to the full accomplishment of the internal market of Community postal services ( 1 ) , as corrected by OJ L 225, 28.8.2015, p. 49 , is to be incorporated into the EEA Agreement.

(2) Commission Decision 2010/C 217/07 of 10 August 2010 establishing the European Regulators Group for Postal Services ( 2 ) is to be incorporated into the EEA Agreement.

(3) For the EEA Agreement to function well, Protocol 37 to the EEA Agreement is to be extended to include the European Regulators Group for Postal Services set up by Decision 2010/C 217/07.

(4) Annex XI and Protocol 37 to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XI to the EEA Agreement shall be amended as follows:

Point 5d (Directive 97/67/EC of the European Parliament and of the Council) shall be amended as follows:

(i) The following indent is added:

‘-

32008 L 0006 : Directive 2008/6/EC of the European Parliament and of the Council of 20 February 2008 ( OJ L 52, 27.2.2008, p. 3 ), as corrected by OJ L 225, 28.8.2015, p. 49 .’;

(ii) The text of adaptation (a) is replaced by the following:

‘in Article 5(2), the words “Treaty, in particular Articles 30 and 46 thereof” shall be replaced by the words “EEA Agreement, in particular Articles 13 and 33 thereof”.’;

(iii) Adaptation (b) is deleted.

The following point is inserted after point 5d (Directive 97/67/EC of the European Parliament and of the Council):

‘5da.

32010 D 0811(01) : Commission Decision 2010/C 217/07 of 10 August 2010 establishing the European Regulators Group for Postal Services ( OJ C 217, 11.8.2010, p. 7 ).’

Article 2

The following point is inserted in Protocol 37 to the EEA Agreement:

‘42.

The European Regulators Group for Postal Services (Commission Decision 2010/C 217/07).’

Article 3

The texts of Directive 2008/6/EC, as corrected by OJ L 225, 28.8.2015, p. 49 , and Decision 2010/C 217/07 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 26 September 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
