DECISION OF THE EEA JOINT COMMITTEE No 149/2020

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2023/1724]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2020/196 of 13 February 2020 concerning the renewal of the authorisation of endo-1,4-beta-xylanase produced by Aspergillus niger CBS 109.713 as a feed additive for chickens for fattening, turkeys for fattening, turkeys reared for breeding, minor avian species (except laying birds) and ornamental birds and repealing Regulations (EC) No 1380/2007, (EC) No 1096/2009 and Implementing Regulation (EU) No 843/2012 (holder of authorisation BASF SE) ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2020/197 of 13 February 2020 concerning the authorisation of allura red AC as a feed additive for cats and dogs ( 2 ) is to be incorporated into the EEA Agreement.

(3) Implementing Regulation (EU) 2020/196 repeals Commission Regulations (EC) No 1380/2007 ( 3 ) , (EC) No 1096/2009 ( 4 ) and Commission Implementing Regulation (EU) No 843/2012 ( 5 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(4) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(5) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The texts of points 1zzzze (Commission Regulation (EC) No 1380/2007), 1zzzzzu (Commission Regulation (EC) No 1096/2009) and 70 (Commission Implementing Regulation (EU) No 843/2012) are deleted.

Article 2

The texts of Implementing Regulations (EU) 2020/196 and (EU) 2020/197 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 24 October 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
