DECISION OF THE EEA JOINT COMMITTEE No 70/2021
of 5 February 2021
amending Annex XIX (Consumer protection) to the EEA Agreement [2024/53]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:
(1) Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services ( 1 ) is to be incorporated into the EEA Agreement.
(2) Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods, amending Regulation (EU) 2017/2394 and Directive 2009/22/EC, and repealing Directive 1999/44/EC ( 2 ) is to be incorporated into the EEA Agreement.
(3) Directive (EU) 2019/771 repeals, with effect from 1 January 2022, Directive 1999/44/EC of the European Parliament and of the Council ( 3 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 1 January 2022.
(4) Annex XIX to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Annex XIX to the EEA Agreement shall be amended as follows:
1.
The following indents are added in points 7d (Directive 2009/22/EC of the European Parliament and of the Council) and 7f (Regulation (EU) 2017/2394 of the European Parliament and of the Council):

32019 L 0770 : Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 ( OJ L 136, 22.5.2019, p. 1 ),
- 32019 L 0771 : Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 ( OJ L 136, 22.5.2019, p. 28 ).’

The following is inserted after point 7l (Directive (EU) 2015/2302 of the European Parliament and of the Council):
‘7m.
32019 L 0770 : Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services ( OJ L 136, 22.5.2019, p. 1 ).
The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:
References to Union law shall be understood as references to the EEA Agreement.

32019 L 0771 : Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects concerning contracts for the sale of goods, amending Regulation (EU) 2017/2394 and Directive 2009/22/EC, and repealing Directive 1999/44/EC ( OJ L 136, 22.5.2019, p. 28 ).
The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:

3.
The text of point 7e (Directive 1999/44/EC of the European Parliament and of the Council) shall be deleted with effect from 1 January 2022.
Article 2
The texts of Directives (EU) 2019/770 and (EU) 2019/771 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.
Article 3
This Decision shall enter into force on 6 February 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 172/2019 of 14 June 2019 ( 4 ) , whichever is the later.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
