DECISION OF THE EEA JOINT COMMITTEE No 220/2021

amending Annex XX (Environment) to the EEA Agreement [2024/280]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Decision (EU) 2020/1071 of 18 May 2020 amending Directive 2003/87/EC of the European Parliament and of the Council, as regards the exclusion of incoming flights from Switzerland from the EU emissions trading system ( 1 ) is to be incorporated into the EEA Agreement.

(2) Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Point 21al (Directive 2003/87/EC of the European Parliament and of the Council) of Annex XX to the EEA Agreement is amended as follows:

The following indent is added:

‘-

32020 D 1071 : Commission Delegated Decision (EU) 2020/1071 of 18 May 2020 ( OJ L 234, 21.7.2020, p. 16 ).’

Adaptation (u) is renumbered as adaptation (v).

The following adaptation is inserted after adaptation (t):

‘(u)

In the second paragraph of the entry ‘Aviation’ of column ‘Activities’ of the table in Annex I, the second paragraph of point (j), points (k) and (l) shall apply from 1 January 2020.’

Article 2

The text of Delegated Decision (EU) 2020/1071 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 10 July 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
