DECISION OF THE EEA JOINT COMMITTEE No 276/2021

amending Annex XI (Electronic communication, audiovisual services and information society) to the EEA Agreement [2024/478]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2019/2243 of 17 Decembre 2019 establishing a template for the contract summary to be used by providers of publicly available electronic communications services pursuant to Directive (EU) 2018/1972 of the European Parliament and of the Council ( 1 ) , as corrected by OJ L 16, 21.1.2020, p. 40 , is to be incorporated into the EEA Agreement.

(2) Annex XI to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 5czs (Directive (EU) 2018/1972 of the European Parliament and of the Council) of Annex XI to the EEA Agreement:

‘5czsa.

32019 R 2243 : Commission Implementing Regulation (EU) 2019/2243 of 17 Decembre 2019 establishing a template for the contract summary to be used by providers of publicly available electronic communications services pursuant to Directive (EU) 2018/1972 of the European Parliament and of the Council, as corrected by OJ L 16, 21.1.2020, p. 40 ( OJ L 336, 30.12.2019, p. 274 ).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

In the Annex, as regards the EFTA States:

(i) in part A, the words “EU law” shall be replaced by the words “the EEA Agreement”;

(ii) in part B, references to Union law shall be understood as references to the EEA Agreement.’

Article 2

The text of Implementing Regulation (EU) 2019/2243, as corrected by OJ L 16, 21.1.2020, p. 40 , in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 25 September 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 275/2021 of 24 September 2021 ( 2 ) , whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
