DECISION OF THE EEA JOINT COMMITTEE No 234/2021

amending Annex I (Veterinary and phytosanitary matters), Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement 2024/466
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:
(1) Regulation (EU) 2019/1381 of the European Parliament and of the Council of 20 June 2019 on the transparency and sustainability of the EU risk assessment in the food chain and amending Regulations (EC) No 178/2002, (EC) No 1829/2003, (EC) No 1831/2003, (EC) No 2065/2003, (EC) No 1935/2004, (EC) No 1331/2008, (EC) No 1107/2009, (EU) 2015/2283 and Directive 2001/18/EC ( 1 ) is to be incorporated into the EEA Agreement.
(2) This Decision concerns, inter alia, legislation regarding veterinary matters, feedingstuffs and foodstuffs. Legislation regarding veterinary matters, feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and in the introduction to Chapter XII of Annex II to the EEA Agreement.
(3) Annexes I, II and XX to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Annex I to the EEA Agreement is amended as follows:
1.
Point 13 (Regulation (EC) No 178/2002 of the European Parliament and of the Council) in Part 7.1 of Chapter I is amended as follows:
(i) the following indent is added:
‘—
32019 R 1381 : Regulation (EU) 2019/1381 of the European Parliament and of the Council of 20 June 2019 ( OJ L 231, 6.9.2019, p. 1 ).’
(ii) adaptations (e) to (l) are renumbered as adaptations (h) to (o).
(iii) the following adaptations are added after adaptation (d):
‘(e)
The EFTA States shall participate fully in the Management Board of the Authority and shall within it have the same rights and obligations as EU Member States, except for the right to vote.
(f) In Article 25(1) the following shall be added:
“Each EFTA State shall appoint one member and one alternate member as its representatives to the Management Board, without the right to vote.”
(g) In paragraph 1a of Article 25, the following point shall be added:
“(d)
one member and one alternate member appointed by the EFTA Surveillance Authority, without the right to vote.”’
2.
The following indent is added in point 1a (Regulation (EC) No 1831/2003 of the European Parliament and of the Council) of Chapter II:
‘—
32019 R 1381 : Regulation (EU) 2019/1381 of the European Parliament and of the Council of 20 June 2019 ( OJ L 231, 6.9.2019, p. 1 ).’
3.
Point 41 (Regulation (EC) No 178/2002 of the European Parliament and of the Council) of Chapter II is amended as follows:
(i) the following indent is added:
‘—

(ii) adaptations (e) to (m) are renumbered as adaptations (h) to (p).
(iii) the following adaptations are added after adaptation (d):
‘(e)
The EFTA States shall participate fully in the Management Board of the Authority and shall within it have the same rights and obligations as EU Member States, except for the right to vote.
(f) In Article 25(1) the following shall be added:

Article 2
Annex II to the EEA Agreement shall be amended as follows:

The following is added in points 54zzp (Regulation (EC) No 2065/2003 of the European Parliament and of the Council), 54zzt (Regulation (EC) No 1935/2004 of the European Parliament and of the Council), 54zzzzp (Regulation (EC) No 1331/2008 of the European Parliament and of the Council) and 124 (Regulation (EU) 2015/2283 of the European Parliament and of the Council) of Chapter XII:
‘, as amended by:
— 32019 R 1381 : Regulation (EU) 2019/1381 of the European Parliament and of the Council of 20 June 2019 ( OJ L 231, 6.9.2019, p. 1 ).’

Point 54zzzc (Regulation (EC) No 178/2002 of the European Parliament and of the Council) of Chapter XII is amended as follows:
(i) the following indent is added:
‘—
32019 R 1381 : Regulation (EU) 2019/1381 of the European Parliament and of the Council of 20 June 2019 ( OJ L 231, 6.9.2019, p. 1 ).’
(ii) adaptations (e) to (m) are renumbered as adaptations (h) to (p).
(iii) the following adaptations are added after adaptation (d):
‘(e)

The following indent is added in point 13 (Regulation (EC) No 1107/2009 of the European Parliament and of the Council) of Chapter XV:

Article 3
The following indent is added in point 25d (Directive 2001/18/EC of the European Parliament and of the Council) of Annex XX to the EEA Agreement:
‘—
32019 R 1381 : Regulation (EU) 2019/1381 of the European Parliament and of the Council of 20 June 2019 ( OJ L 231, 6.9.2019, p. 1 ).’
Article 4
The text of Regulation (EU) 2019/1381 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.
Article 5
This Decision shall enter into force on 25 September 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .
Article 6
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
