DECISION OF THE EEA JOINT COMMITTEE No 387/2021

amending Annex IX (Financial services) to the EEA Agreement [2024/653]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2019/361 of 13 December 2018 amending Delegated Regulation (EU) No 151/2013 with regard to access to the data held in trade repositories ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Delegated Regulation (EU) 2019/362 of 13 December 2018 amending Delegated Regulation (EU) No 150/2013 as regards regulatory technical standards specifying the details of the application for registration as a trade repository ( 2 ) is to be incorporated into the EEA Agreement.

(3) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement shall be amended as follows:

(1) the following is added in point 31bcg (Commission Delegated Regulation (EU) No 150/2013):

‘, as amended by:

— 32019 R 0362 : Commission Delegated Regulation (EU) 2019/362 of 13 December 2018 ( OJ L 81, 22.3.2019, p. 74 ).’;

(2) point 31bch (Commission Delegated Regulation (EU) No 151/2013) is amended as follows:

(i) the following indent is added:

‘—

32019 R 0361 : Commission Delegated Regulation (EU) 2019/361 of 13 December 2018 ( OJ L 81, 22.3.2019, p. 69 ).’;

(ii) adaptation (a) is replaced by the following:

‘(a)

References to members of the ESCB shall be understood to include, in addition to their meaning in the Delegated Regulation, the national central banks of the EFTA States.’.

Article 2

The texts of Delegated Regulations (EU) 2019/361 and (EU) 2019/362 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 11 December 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 385/2021 of 10 December 2021 ( 3 ) , or on the day of the entry into force of Decision of the EEA Joint Committee No 50/2021 of 5 February 2021 ( 4 ) , whichever is the latest.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
