DECISION OF THE EEA JOINT COMMITTEE No 323/2021

of 10 December 2021

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/724]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2021/932 of 9 June 2021 suspending the authorisation of lasalocid A sodium (Avatec 15 % cc) and lasalocid A sodium (Avatec 150 G) as feed additives for chickens for fattening and chickens reared for laying (holder of authorisation Zoetis Belgium S.A.) ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2021/967 of 16 June 2021 concerning the renewal of the authorisation of manganese chelate of hydroxy analogue of methionine as a feed additive for all animal species, and repealing Regulation (EU) No 350/2010 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2021/968 of 16 June 2021 concerning the renewal of the authorisation of zinc chelate of hydroxy analogue of methionine as a feed additive for all animal species, and repealing Regulation (EU) No 335/2010 ( 3 ) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2021/969 of 16 June 2021 concerning the authorisation of L-threonine produced by Escherichia coli CGMCC 13325 as a feed additive for all animal species ( 4 ) is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2021/981 of 17 June 2021 concerning the renewal of the authorisation of a preparation of endo–1,4-beta-xylanase produced by Aspergillus niger CBS 109.713 and endo–1,4-beta-glucanase produced by Aspergillus niger DSM 18404 as a feed additive for poultry species, ornamental birds and weaned piglets (holder of the authorisation: BASF SE), and repealing Regulation (EC) No 271/2009 and Implementing Regulation (EU) No 1068/2011 ( 5 ) is to be incorporated into the EEA Agreement.

(6) Commission Implementing Regulation (EU) 2021/982 of 17 June 2021 concerning the renewal of the authorisation of a preparation of 6-phytase produced by Trichoderma reesei CBS 122001 as a feed additive for pigs and poultry (holder of the authorisation: Roal Oy), and repealing Regulations (EU) No 277/2010, (EU) No 891/2010 and Implementing Regulation (EU) No 886/2011 ( 6 ) is to be incorporated into the EEA Agreement.

(7) Implementing Regulation (EU) 2021/967 repeals Commission Regulation (EU) No 350/2010 ( 7 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(8) Implementing Regulation (EU) 2021/968 repeals Commission Regulation (EU) No 335/2010 ( 8 ) , which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(9) Implementing Regulation (EU) 2021/981 repeals Commission Regulation (EC) No 271/2009 ( 9 ) and Commission Implementing Regulation (EU) No 1068/2011 ( 10 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(10) Implementing Regulation (EU) 2021/982 repeals Commission Regulations (EU) No 277/2010 ( 11 ) and (EU) No 891/2010 ( 12 ) and Commission Implementing Regulation (EU) No 886/2011 ( 13 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(11) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(12) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The texts of points 1zzzzw (Commission Regulation (EC) No 271/2009), 1zzzzzj (Commission Regulation (EU) No 335/2010), 2a (Commission Regulation (EU) No 277/2010), 2e (Commission Regulation (EU) No 350/2010), 2l (Commission Regulation (EU) No 891/2010), 2zm (Commission Implementing Regulation (EU) No 886/2011) and 2zq (Commission Implementing Regulation (EU) No 1068/2011) are deleted.

Article 2

The texts of Implementing Regulations (EU) 2021/932, (EU) 2021/967, (EU) 2021/968, (EU) 2021/969, (EU) 2021/981 and (EU) 2021/982 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 11 December 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
