COUNCIL DECISION (CFSP) 2022/1625

of 20 September 2022

on the consequences of the decision of the High Representative on the reorganisation of the civilian crisis management structures in the European External Action Service as regards the function of Civilian Operation Commander for civilian crisis management missions

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 42(4) and Article 43(2) thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:
(1) By Decision ADMIN(2022)50 of 3 August 2022, the High Representative of the Union for Foreign Affairs and Security Policy (the ‘High Representative’) decided on a reorganisation of the central administration of the European External Action Service (EEAS), in particular as regards the management of the civilian planning and conduct capability (CPCC) referred to in Article 4(3), point (a), 3rd indent of Council Decision 2010/427/EU (1).
(2) In particular, the High Representative decided that as from 16 September 2022, the CPCC will be placed under the authority of a Managing Director and no longer under the authority of a Director.
(3) The Managing Director of the CPCC will also exercise, on the basis of, and in accordance with, each decision of the Council establishing a civilian crisis management mission pursuant to Article 42(4) and Article 43(2) of the Treaty on European Union, the function of Civilian Operation Commander.
(4) As a consequence, and in order to ensure legal certainty, all references to the Director of the CPCC in existing Council decisions establishing a civilian crisis management mission should be read, as from 16 September 2022, as references to the Managing Director of the CPCC. Future decisions of the Council establishing a civilian crisis management mission should provide that the Managing Director of the CPCC will exercise the function of Civilian Operation Commander,
HAS ADOPTED THIS DECISION:

Article 1

As a consequence of the decision of the High Representative to place the civilian planning and conduct capability (CPCC) within the EEAS under the authority of a Managing Director, the relevant provisions of existing Council decisions establishing a civilian crisis management mission providing that the Director of the CPCC shall be the Civilian Operation Commander shall apply to the Managing Director of the CPCC.

Article 2

This Decision shall enter into force on the date of its adoption.
It shall apply from 16 September 2022.
