    COMMISSION DECISION (EU) 2023/1409

    of 4 July 2023

    instructing the Central Administrator of the Union Registry to return to the Member States and the United Kingdom the Union surplus at the end of the second commitment period of the Kyoto Protocol

    THE EUROPEAN COMMISSION,
    Having regard to the Treaty on the Functioning of the European Union,
    Having regard to Council Decision (EU) 2015/1339 of 13 July 2015 on the conclusion, on behalf of the European Union, of the Doha Amendment to the Kyoto Protocol to the United Nations Framework Convention on Climate Change and the joint fulfilment of commitments thereunder (1), and in particular Article 4 thereof,
    Whereas:
    (1) The Union concluded the Doha Amendment to the Kyoto Protocol to the United Nations Framework Convention on Climate Change. The Doha Amendment established a second commitment period of the Kyoto Protocol, starting on 1 January 2013 and ending on 31 December 2020.
    (2) In accordance with Article 4 of Decision (EU) 2015/1339, all assigned amount units issued for the second commitment period available in the Union registry after the Union has complied with its obligation laid down in Article 11(3) of Regulation (EU) No 525/2013 of the European Parliament and of the Council (2) and after any transfer of assigned amount units pursuant to implementing acts adopted on the basis of Article 10(7) of Regulation (EU) No 525/2013 has been carried out (‘Union surplus’) shall be returned to the Member States at the end of the second commitment period.
    (3) After transferring the applicable share of proceeds to the Adaptation Fund, there is a net Union surplus in the Union Registry of 2 215 147 885 assigned amount units. These units should be returned to the Member States and the United Kingdom (3) in accordance with the rules set out in Article 4(2) of Decision (EU) 2015/1339.
    (4) The Commission should instruct the central administrator of the Union Registry to return the units to the Member States and the United Kingdom,
    HAS DECIDED AS FOLLOWS:

    Sole Article

    The Commission instructs the central administrator of the Union Registry to return to the accounts of Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom the assigned amount units set out in Annex.
