COMMISSION RECOMMENDATION No 2797/80/ECSC of 31 October 1980 on Community monitoring at importers of import and resale prices in respect of the importation of certain iron and steel products covered by the ECSC Treaty and originating in non-member countries
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Coal and Steel Community, and in particular Article 86 thereof,
Whereas the Commission has, by Decision No 2794/80/ECSC (1), established a system of production quotas including provisions for monitoring these quotas and for sanctions for breaches of the Decision;
Whereas these measures should be accompanied by measures ensuring more efficient monitoring than heretofore of import prices of ECSC iron and steel products;
Whereas Commission recommendation No 587/80/ECSC of 7 March 1980 (2) provides inter alia for Community monitoring at the frontier of the terms of imports of certain iron and steel products from non-member countries into the Community;
Whereas in order to ensure fulfilment of the obligations resulting from recommendation No 587/80/ECSC and to facilitate the performance of the Community's tasks, the Member States should take all appropriate measures in conformity with Article 86 of the ECSC Treaty;
Whereas a small and diminishing number of cases of price undercutting have recently been revealed by examination at frontier of the prices of imports ; whereas such price undercuttings as have been revealed have not been very significant ; whereas this does not correspond to the general weakening of prices on the Community market ; whereas it is therefore to be doubted if these at-frontier examinations of import prices are revealing the complete picture;
Whereas, accordingly, it is advisable to obtain further information by means of selective inspections of the records kept by importers, of prices paid and, where relevant, prices charged for the further sale of the goods in question, in order to see if the information obtained from these various sources is consistent,
HAS ADOPTED THIS RECOMMENDATION:
Article 1
Member States shall take the steps required to satisfy themselves, where it appears necessary, that the information received in application of recommendation No 587/80/ECSC tallies with the information received from their inspections of the records kept by importers concerning in particular the price paid for the goods in question and, where applicable, the price charged for the further sale of the goods not being further worked.
The Member States shall regularly inform the Commission of the measures taken and their results.
Article 2
This recommendation is addressed to the Member States.
It shall apply with effect from 1 January 1981.
