DECISION OF THE EEA JOINT COMMITTEE

amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Decision 2011/633/EU of 15 September 2011 on the common specifications of the register of railway infrastructure(1) is to be incorporated into the EEA Agreement.

(2) Commission Decision 2012/462/EU of 23 July 2012 amending Decisions 2002/731/EC, 2002/732/EC, 2002/733/EC, 2002/735/EC and 2006/66/EC and repealing Decision 2002/730/EC concerning technical specifications for interoperability(2) is to be incorporated into the EEA Agreement.

(3) Commission Decision 2012/463/EU of 23 July 2012 amending Decisions 2006/679/EC and 2006/860/EC concerning technical specifications for interoperability(3) is to be incorporated into the EEA Agreement.

(4) Commission Decision 2012/464/EU of 23 July 2012 amending Decisions 2006/861/EC, 2008/163/EC, 2008/164/EC, 2008/217/EC, 2008/231/EC, 2008/232/EC, 2008/284/EC, 2011/229/EU, 2011/274/EU, 2011/275/EU, 2011/291/EU and 2011/314/EU concerning technical specifications for interoperability(4) is to be incorporated into the EEA Agreement.

(5) Decision 2012/462/EU repeals Commission Decision 2002/730/EC(5) which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(6) Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

(1) the following indent is added in points 37ab (Commission Decision 2002/731/EC) and 37af (Commission Decision 2002/735/EC):

(9) the text of point 37aa (Commission Decision 2002/730/EC) is deleted.

Article 2

The texts of Implementing Decision 2011/633/EU and Decisions 2012/462/EU, 2012/463/EU and 2012/464/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the

Official Journal of the European Union

, shall be authentic.

Article 3

This Decision shall enter into force on 15 February 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(6).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the

Official Journal of the European Union
