Declaration by the European Union made in accordance with the third paragraph of Article 185 of the Agreement on the Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community

The European Union declares that, in accordance with the third paragraph of Article 185 of the Agreement on the Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, the following Member States of the European Union have availed themselves of the possibility provided for in that paragraph under which, during the transition period, in addition to the grounds for non-execution of a European arrest warrant referred to in Framework Decision 2002/584/JHA, the executing judicial authorities of these Member States may refuse to surrender their respective nationals to the United Kingdom pursuant to a European arrest warrant:

— the Federal Republic of Germany;

— the Republic of Austria;

— the Republic of Slovenia.
