DECISION OF THE EEA JOINT COMMITTEE No 95/2022

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2022/1539]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2021/808 of 22 March 2021 on the performance of analytical methods for residues of pharmacologically active substances used in food-producing animals and on the interpretation of results as well as on the methods to be used for sampling and repealing Decisions 2002/657/EC and 98/179/EC  ( 1 ) , is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2021/810 of 20 May 2021 amending Implementing Regulation (EU) 2021/808 as regards transitional provisions for certain substances listed in Annex II to Decision 2002/657/EC  ( 2 ) , as corrected by OJ L 186, 27.5.2021, p. 33 , is to be incorporated into the EEA Agreement.

(3) Implementing Regulation (EU) 2021/808 repeals Commission Decisions 98/179/EC  ( 3 ) and 2002/657/EC  ( 4 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(4) This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(5) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Part 7.2 of Chapter I of Annex I to the EEA Agreement shall be amended as follows:

(1) The text of point 14 (Commission Decision 98/179/EC) shall be replaced by the following:

‘ 32021 R 0808 : Commission Implementing Regulation (EU) 2021/808 of 22 March 2021 on the performance of analytical methods for residues of pharmacologically active substances used in food-producing animals and on the interpretation of results as well as on the methods to be used for sampling and repealing Decisions 2002/657/EC and 98/179/EC ( OJ L 180, 21.5.2021, p. 84 ), as amended by:

— 32021 R 0810 : Commission Implementing Regulation (EU) 2021/810 of 20 May 2021 ( OJ L 180, 21.5.2021, p. 112 ), as corrected by OJ L 186, 27.5.2021, p. 33 .’

(2) The text of point 19 (Commission Decision 2002/657/EC) is deleted.

Article 2

The texts of Implementing Regulations (EU) 2021/808 and (EU) 2021/810, as corrected by OJ L 186, 27.5.2021, p. 33 , in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 30 April 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
