DECISION OF THE EEA JOINT COMMITTEE No 105/2022

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2022/1549]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2021/1929 of 8 November 2021 amending Regulation (EU) No 142/2011 as regards conditions for exports of certain organic fertilisers and soil improvers containing Category 2 materials ( 1 ) is to be incorporated into the EEA Agreement.

(2)

Commission Delegated Regulation (EU) 2021/2156 of 17 September 2021 supplementing Regulation (EU) 2017/625 of the European Parliament and of the Council by establishing the European Union reference laboratory for Rift Valley fever ( 2 ) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Regulation (EU) 2021/632 of 13 April 2021 laying down rules for the application of Regulation (EU) 2017/625 of the European Parliament and of the Council as regards the lists of animals, products of animal origin, germinal products, animal by-products and derived products, composite products, and hay and straw subject to official controls at border control posts, and repealing Commission Implementing Regulation (EU) 2019/2007 and Commission Decision 2007/275/EC ( 3 ) is to be incorporated into the EEA Agreement.

Implementing Regulation (EU) 2021/632 repeals Commission Implementing Regulation (EU) 2019/2007 ( 4 ) and Commission Decision 2007/275/EC ( 5 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

This Decision concerns, inter alia , legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement.

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annexes I and II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to the EEA Agreement shall be amended as follows:

(1)

The texts of points 11bo (Commission Implementing Regulation (EU) 2019/2007) in Part 1.1 of Chapter I and 31qo (Commission Implementing Regulation (EU) 2019/2007) of Chapter II are replaced by the following:

‘ 32021 R 0632 : Commission Implementing Regulation (EU) 2021/632 of 13 April 2021 laying down rules for the application of Regulation (EU) 2017/625 of the European Parliament and of the Council as regards the lists of animals, products of animal origin, germinal products, animal by-products and derived products, composite products, and hay and straw subject to official controls at border control posts, and repealing Commission Implementing Regulation (EU) 2019/2007 and Commission Decision 2007/275/EC ( OJ L 132, 19.4.2021, p. 24 ).

This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part.’

The following is inserted after point 50 (Commission Implementing Decision (EU) 2018/1136) in Part 3.1 of Chapter I:

‘51.

32021 R 2156 : Commission Delegated Regulation (EU) 2021/2156 of 17 September 2021 supplementing Regulation (EU) 2017/625 of the European Parliament and of the Council by establishing the European Union reference laboratory for Rift Valley fever ( OJ L 436, 7.12.2021, p. 26 ).

This act shall not apply to Iceland.’

The following indent is added in point 9c (Commission Regulation (EU) No 142/2011) in Part 7.1 of Chapter I:

‘—

32021 R 1929 : Commission Regulation (EU) 2021/1929 of 8 November 2021 ( OJ L 394, 9.11.2021, p. 4 ).’

The text of point 137 (Commission Decision 2007/275/EC) in Part 1.2 of Chapter I is deleted.

Article 2

The text of point 164o (Commission Implementing Regulation (EU) 2019/2007) of Chapter XII of Annex II to the EEA Agreement is replaced by the following:

Article 3

The texts of Regulation (EU) 2021/1929, Delegated Regulation (EU) 2021/2156 and Implementing Regulation (EU) 2021/632 and in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 30 April 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( * ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
