DECISION OF THE EEA JOINT COMMITTEE No 176/2022

of 10 June 2022

amending Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement [2022/1876]

THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

Commission Implementing Regulation (EU) 2017/699 of 18 April 2017 establishing a common methodology for the calculation of the weight of electrical and electronic equipment (EEE) placed on the market of each Member State and a common methodology for the calculation of the quantity of waste electrical and electronic equipment (WEEE) generated by weight in each Member State  ( 1 ) is to be incorporated into the EEA Agreement.

Directive 2012/19/EU of the European Parliament and of the Council  ( 2 ) was incorporated into Annex XX of the EEA Agreement by Decision of the EEA Joint Committee No 195/2015 of 10 July 2015  ( 3 ) .
(3)
As Liechtenstein is integrated in the Swiss system for waste from electrical and electronic equipment, there are no Liechtenstein specific data regarding waste electrical and electronic equipment. Liechtenstein should therefore be exempted from Articles 7, 11 and 16 of Directive 2012/19/EU and Annexes II and XX to the Agreement should be amended accordingly.

Based on Liechtenstein’s exemption from Article 7 of Directive 2012/19/EU, Commission Implementing Regulation (EU) 2017/699 should not apply to Liechtenstein.
(5)
Annexes II and XX to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 9daa (Commission Implementing Decision (EU) 2021/1752) of Chapter XVII of Annex II to the EEA Agreement:
‘9e.
32012 L 0019 : Directive 2012/19/EU of the European Parliament and of the Council of 4 July 2012 on waste electrical and electronic equipment (WEEE) ( OJ L 197, 24.7.2012, p. 38 ).
The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:
Articles 7, 11 and 16 shall not apply to Liechtenstein.

32017 R 0699 : Commission Implementing Regulation (EU) 2017/699 of 18 April 2017 establishing a common methodology for the calculation of the weight of electrical and electronic equipment (EEE) placed on the market of each Member State and a common methodology for the calculation of the quantity of waste electrical and electronic equipment (WEEE) generated by weight in each Member State ( OJ L 103, 19.4.2017, p. 17 ).
The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:
This Regulation shall not apply to Liechtenstein.’

Article 2

Annex XX to the EEA Agreement shall be amended as follows:
(1)
the text of point 32fa (Directive 2012/19/EU of the European Parliament and of the Council) is replaced by the following:
‘32fa.
32012 L 0019 : Directive 2012/19/EU of the European Parliament and of the Council of 4 July 2012 on waste electrical and electronic equipment (WEEE) ( OJ L 197, 24.7.2012, p. 38 ).
The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:
Articles 7, 11 and 16 shall not apply to Liechtenstein.’;
(2)
the following is inserted after point 32fa (Directive 2012/19/EU of the European Parliament and of the Council):
‘32faa.

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:
This Regulation shall not apply to Liechtenstein.’.

Article 3

The text of Implementing Regulation (EU) 2017/699 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 11 June 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( * ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
