DECISION OF THE EEA JOINT COMMITTEE No 173/2022

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2022/1873]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Decision (EU) 2019/665 of 17 April 2019 amending Decision 2005/270/EC establishing the formats relating to the database system pursuant to European Parliament and Council Directive 94/62/EC on packaging and packaging waste ( 1 ) is to be incorporated into the EEA Agreement.

(2) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is added in point 7e (Commission Decision 2005/270/EC) of Chapter XVII of Annex II to the EEA Agreement:

‘-

32019 D 0665 : Commission Implementing Decision (EU) 2019/665 of 17 April 2019 ( OJ L 112, 26.4.2019, p. 26 ).

The provisions of the Decision shall, for the purposes of this Agreement, be read with the following adaptation:

For the purposes of Article 6c and Annex II, Liechtenstein shall use an equivalent method to determine the weight of the municipal waste recycled.’

Article 2

The text of Implementing Decision (EU) 2019/665 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 11 June 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( * ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
